भदोही/नई दिल्ली । भारत सरकार के विदेश व्यापार प्रक्रिया नीति 2015 -20 में एक्सपोर्ट प्रमोशन कौंसिल को पारदर्शी बनाने के लिये दिए गए नियमो का पालन करने का निर्देश दिया है ऐसे परिषद में 2017 में हुए चुनाव को फिर कराना पड़ सकता है भारत के ftp पालिसी 2015-20 के प्रकिया में परिषदों को और लोकतांत्रिक बनाने के लिए अपने पैरा 2.91और 2.92 में उपबंध दिए हए थे जिसका अनुपालन 2016 तक करने निर्देश दिए गए जिसमे यह कहा गया था कि इसका पालन नही किया गया तो मंत्रालय ग्रांट रोक देगी, अब केंद्रीय वस्त्र मंत्रालय ने इस संदर्भ में पत्र भेजकर इसका अनुपान करने का निर्देश दिया है । हालाकि परिषद ने अपने 28 जनवरी 2019 के egm मीटिंग में इसमें संशोधन करके कपड़ा मंत्रालय को भेज दिया है ,यदि कपड़ा मंत्रालय ने इन संसोधनों को स्वीकृत नही किया तो फिर परिषद को फिर से अपने प्रथम द्वितीय सहित 5 समिति के सदस्यों का फिर से चुनाव कराना होगा,
हालांकि परिषद ने इससे बचने के लिए अपने वर्तमान सदस्यों का कार्यकाल 4 वर्ष करने प्रस्ताव सरकार को भेजा है जिसे पूर्व चेयरमैन ओपी गर्ग ने इसे नियमो के विरुद्ध बताया है ।
Ftp 2015-20 में के नए नियमो के अनुसार प्रथम उपाध्यक्ष परिषद के चेयरमैन कार्यकाल समाप्त हो जाने के बाद स्वतः चेयरमैन बन जायेगा और साथ ही प्रथम उपाध्यक्ष का चुनाव वर्तमान मेंबर ही लड़ सकता है उपाध्यक्ष बनने के लिए उसका वर्तमान में प्रसासनिक समिति का सदस्य होना जरूरी है इन नियमो के तहत चुनाव होना चाहिए ,
इन नियमो के पालन के किये मंत्रालय ने 19 सितंबर 2018 को परिषद के अधिशासी निदेशक, संजय कुमार को पत्र भेजकर चुनाव में नियमों का पालन कराने और पुंन 21 जनवरी को रिमाइंडर भेजा है।
फरवरी 2017 में परिषद के प्रथम उपाध्यक्ष पद पर सिद्धनाथ सिंह, द्वितीय उपाध्यक्ष पद पर उमर हमीद के अलावा प्रशासनिक सदस्यों के पांच रिक्त पदों पर अब्दुल रब, राजेंद्र मिश्रा, हुसैन जाफर, सतीश वाटल और बोधराज मल्होत्रा का निर्वाचन निर्विरोध हुआ था। निर्वाचन के बाद परिषद के पूर्व चेयरमैन ओपी गर्ग ने चुनाव में नियमों और निर्देशों की अनदेखी के आरोप लगाते हुए उच्चाधिकारियों को पत्रक भेजे थे। चुनाव के लगभग डेढ़ साल बाद 21 सितंबर को अंडर सेक्रेट्री भारत सरकार आरके सिंह ने परिषद को पत्र जारी कर चुनाव नए सिरे से कराने का निर्देश दिया। यह भी कहा गया है कि अन्यथा की स्थिति में परिषद को एमएआई योजना के तहत मिलने वाली ग्रांट पर रोक लगा दी जाएगी।
पूरे मामले को केंद्र सरकार के संज्ञान में लाने वाले पूर्व चेयरमैन ओपी गर्ग ने बताया कि सात दिसंबर 2015 को वाणिज्य मंत्रालय ने सभी निर्यात संवर्धन परिषदों को निर्देशित किया था कि अपने अपने बाइलाज में संशोधन करें कि उपाध्यक्ष का निर्वाचन प्रशासनिक समिति के सदस्यों में से होगा, परिषद ने इसे संंशोधन नही किया

परिषद के निदेशक संजय कुमार बताया कि इस संबंध में 19 सितंबर के वस्त्र मंत्रालय के पत्र का जवाब संबंधित अधिकारी को दिया जा चुका है। यदि मंत्रालय कोई और दिशा निर्देश जारी करता है तो उसका पालन किया जाएगा। गत 28 जनवरी को नई दिल्ली में हुए असाधारण आम सभा की बैठक में परिषद के बाईलाज में सरकार द्वारा वांछित बदलाव कर दिए गए हैं।
भारतीय विदेश नीति 2015-20 प्रक्रिया संख्या 2.91और 2.92 के अनुसार
Export Promotion Council (EPC)/ Commodity Boards:
2.91 Registering Authorities
(a) Registering Authority is a body notified by DGFT in this regard to
register importers/ exporters as its members by issuing RCMC.
(b) The list of notified Registering Authorities is at Appendix-2 T.
(c) EPCs acting as the Registering Authorities for RCMC at present will
continue to act as Registering Authorities and issue RCMC to their
members till 31st March, 2016. EPCs wishing to continue as
Registering Authority for their product group thereafter shall have to
comply and fulfil the conditions as specified in Paragraph 2.92 below
before 31st March, 2016.
2.92 Criteria for EPCs as Registering Authorities
In order to make the EPCs truly democratic and participative in nature
and for better governance and transparency, the criteria for them to
function as Registering Authority are being laid down as under:
(a) e-Voting: Electronic Voting would be mandatory for election to the
posts of Vice Chairman/Vice President and Executive Committee
members with a view to ensuring wider participation.
(b) Tenure of Elected Heads: The tenure of an elected head shall not be
for more than two years. The election of Chairman/President of the
EPC shall be via Vice Chairman/Vice President route. However, any
member having held the post of Chairman/President and/or Vice
Chairman/Vice President may come back as Vice Chairman/Vice
President in the same council after a gap of not less than 4 years.
(c) Directions of the Central Government: EPCs acting as the
Registering Authorities shall abide by all directions of the Central
Government in respect of promotion and development of
international trade.
2.92 Registration- cum- Membership Certificate (RCMC)
(a) An exporter may, on application given in ANF 2C register and
become a member of EPC. On being admitted to membership,
applicant shall be granted forthwith Registration-cum-Membership
Certificate (RCMC) of EPC concerned, in format given in Appendix
2R, . In case an exporter desires to get registration as a manufacturer
exporter, he shall furnish evidence to that effect.
(b) Prospective / potential exporters may also, on application, register
and become an associate member of an EPC.
2.94 Applying for RCMC
(a) While applying for RCMC, an exporter has to declare his main line of
business in the application. The exporter is required to obtain RCMC
from the Council which is concerned with the product of his main
line of business.
(b) In case an export product is not covered by any Export Promotion
Council/Commodity Board etc., RCMC in respect thereof is to be
obtained from FIEO. Further, in case of multi product exporters, not
registered with any EPC, where main line of business is yet to be
settled, the exporter has an option to obtain RCMC from Federation
of Indian Exporters Organization (FIEO).
(c) In respect of multi product exporters having their head office/
registered office in the North Eastern States, RCMC may be obtained
from Shellac & Forest Products Export Promotion Council (except for
the products looked after by APEDA, Spices Board and Tea Board).
(d) In respect of exporters of handicrafts and handloom products from
the State of Jammu & Kashmir, Director, Handicrafts, Government of
Jammu & Kashmir is authorised to issue Registration Cum
Membership Certificate (RCMC)
